Customer Terms and Conditions

If you wish to book a tour or transportation services using Czech Global Hosts (“CGH”) then you (“the Customer”) agree that the following terms and conditions shall apply:

Contract

By using CGH or any affiliated website you agree to be legally bound by the following Terms and Condition which shall take effect immediately. Please ensure that you carefully read and understand these Terms and Conditions prior to booking. You represent and warrant that you are authorized to accept The Company’s Terms & Conditions on behalf of everyone named in your booking.

Booking Process

Bookings can be made via telephone, in person at our booking office or by contacting us through email at chg@czechglobalhosts.com. The Company reserves the right not to confirm the booking until the full amount set out in the invoice received by client is paid, has been received by the Company and all the relevant documentation has been signed and completed in full by the client. Any amendments to or cancellation of the booking shall be subject to these terms and conditions.


Tour Price and Payment

Your CHG Tour or the use of CGH Business Travel Services will be confirmed after receipt of a nonrefundable, non-transferable deposit. We reserve the right to refuse a booking without giving any reason and shall in that event return any deposit received. If your deposit has not yet been received within 7 calendar days of booking, the reservation will automatically by cancelled.

The tour price and the use of CGH Business Travel Services includes only those services/items that are included as per the itinerary and the tour dossier. Customer shall be responsible and pay for any additional items and services that are not specified in the mutual agreement. Such payments are made either directly to a third party service provider or to the Company for settlement with a third party service provider.

The tour price must be paid by not later than 60 days prior to the departure date of the tour, failing which the Company reserves the right to deem the booking as having been cancelled, and to levy the cancellation penalties set out in these terms and conditions. Price for using CGH Business Travel services in the form of transportation must be paid no later than 21 days prior to using those services.

In the event that customer makes a booking within 60 days of the date of departure of the tour, he or she shall, in order to secure the booking, be required to pay the full tour price upfront. CGH Business Travel services booking falling under 21 days will be paid in full in order to secure the booking.

Please review and verify your booking invoice thoroughly and contact us immediately if your invoice appears to be incorrect or incomplete, as it may not be possible to make changes later. The Company cannot accept responsibility if it is not notified of invoice inaccuracies within 5 days of sending out the invoice. In the case of billing errors, The Company reserves the right to re-invoice you with correct pricing.

Deposit and Invoicing

A booking is considered confirmed when CGH sends written confirmation to your valid e-mail address provided at the booking. Invoices are issued on booking confirmation, 30% payment is required to confirm your booking. Full payment is due as above for using CGH Leisure and Business Travel Serivces.

Payment of the deposit confirms you have read and accepted these Terms and Conditions.

CGH reserves the right to cancel the reservation and impose cancellation charges if any payment is not received as detailed above. CGH will not be responsible for any other lost land and/or air reservations.

CGH should be advised of your credit card number when making your reservation directly with us. For security purposes, we are required to collect the guest’s credit card billing address, card expiration date and the customer verification code every time a payment is applied.

Any special meal requirements, including allergies, must be provided at time of booking and are received on a REQUEST basis only. CGH cannot assure special meal requests will be fulfilled and does not assume responsibility or liability if requests are not fulfilled.

Cancellation Conditions

Cancellation of a scheduled tour booking or the use of transportation services must be made in writing and is not effective until such written cancellation is received and acknowledged by CGH.

If cancellation is received in writing by The Company before the final payment due date of your holiday or scheduled business trip, the non-refundable deposit will be retained. If cancellation is received in writing by The Company after the final payment due date of your holiday or business trip, the below specified per cancellation fees apply. The total price specified below does not include discounts, promotions, or special incentives.



All cancellations need to be made in writing and confirmed by the company. If the reason for your cancellation is covered under your insurance, you may be able to reclaim these charges from your insurer.

The Company reserves the right, at any time and for any reason, to cancel the tour or business travel service on notice to the client. In such event, the Company shall refund the tour price or price for business travel service to the client. It is recorded that refund of the tour price or price for CGH business travel service as aforesaid shall be the Company’s sole responsibility to the client, and no claim for any damages, howsoever arising, shall accrue against the Company by reason of a cancellation of our services.

Please be aware that the nature of travel involves risks and unpredictable weather and road conditions and we cannot, therefore, guarantee any departure or arrival times at any particular points of a tour itinerary.

Special Conditions of Tour Application

CGH will not accept any Booking from the Customer unless the Customer is at least 18 years of age. The Customer warrants and assures CGH that they are at least 18 years of age.

The Customer will be required by us to provide photo ID at check-in to ensure that their identity matches the booking identity. The customer will also be required by the Tour Operator to sign the booking confirmation/voucher and may be asked to present the credit card used to purchase the tour. A copy of this photo ID and/or signature may be retained by the CGH to minimize the risk of credit card fraud or for verification purposes with your credit card provider in the event of a dispute.

A customer under 18 years of age travelling alone during the tour period shall provide the Company with the written consent of his/her guardian. Clients under 15 years of age must be accompanied by a parent or guardian.

Guests must ensure they are medically and physically able to travel. Regrettably, motorized scooters are not allowed on guided vacations.

CGH may impose safety requirements and may exclude an individual from participating in a guided vacation or an activity if the individual’s participation poses a direct threat to the health or safety of others that cannot be eliminated by a reasonable modification of policies, practices or procedures or by the provision of auxiliary aids and services. This decision, made solely by CGH, to exclude an individual will be based on an individualized assessment based on reasonable judgment that relies on current medical evidence or on the best available objective evidence to determine the nature, duration and severity of the risk, the probability that potential injury will occur and whether reasonable modifications of policies, practices or procedures will mitigate the risk. No refunds will be given if the decision is made to exclude a guest.

CGH does not provide personal devices (such as wheelchairs, hearing aids or prescription eye glasses) or services of a personal nature (such as eating, toileting or dressing). A traveler who requires services of a personal nature (eating, toileting or dressing, as examples) should consider bringing a companion to provide such assistance and must understand that other travelers and CGH Staff will not be available for such purpose.

Some guided vacations include rough terrain, extensive walking over cobblestone streets, uneven pavement, steps and/or locations which may not be easily accessible or accessible by wheelchair. CGH cannot guarantee disability access or accommodations.

CGH may, in its sole discretion, decline booking any guest or remove any guest who cannot comply or refuses to comply with CGH’s terms and conditions. If this occurs, you are responsible for the cost of travel back to your hometown and CGH shall not be liable for your losses and no refund shall be provided.

Marketing

The Company reserves the right to use any photographs and video taken during the tour for use in marketing or any other advertising material, and the client hereby consents to such use. The client further agrees that the Company shall retain copyright over any such photographs and videos taken during the tour and/or used in its brochures and, to the extent necessary, the client hereby assigns copyright in such photographs and/ or videos to the Company.

Force Majeure

Unforeseen circumstances including but not limited to war, mechanical breakdowns, weather, riots and other unforeseen reasons beyond the control of the Company may cause delays or alterations to the tour or the business transportation services. The Company shall not be held liable in any way for any of these possible occurrences or any consequences, which may arise as a result of these.

Visas & Passports

You are responsible for obtaining and paying for all visas and entry documents, for meeting all health and other requirements, and for any documents required by the laws, regulations, orders, and/or requirements of the countries you will visit. The Company is not responsible for providing specific visa and passport information or documentation, and The Company cannot accept liability for any traveler refused entry onto any transport or into any country due to failure of the traveler to carry correct documentation. All travelers travelling internationally are required to have a passport. Most countries require that the passport be valid for at least six (6) months beyond the conclusion of the trip. It is your responsibility to verify all visa and passport requirements. The process of obtaining a visa and/or passport can take up to three months or more.

Insurance

During travel, injuries may incur large sums of treatment costs or transportation costs. Accidents may also result in claims for damages and compensations in amounts which are difficult to collect from the offender. In order to secure oneself against such cases, we recommend that the customer take out domestic travel insurance of a sufficient amount. It is the customer’s responsibility to ensure that he or she has such insurance in place (together with the required paperwork to prove such insurance) before embarking on the tour. Customer acknowledges that the travel insurance must include comprehensive medical insurance including provision for air evacuation, and that the Company shall not be liable for any consequences, damages or loss as a result of the client failing to have the necessary cover.

BAGGAGE

Due to limited capacity, a single bag is allowed with dimensions not exceeding 30”x18”x10” (76x46x25cm) and weight not exceeding 50 lbs (23kg). Airlines may impose stricter weight and size limits for luggage and may also charge fees for checked baggage, including the first checked bag. Please check with your airline(s) directly for their most current baggage regulations and related fees. CGH is not responsible for additional fees imposed by air carriers regarding baggage. Carry-on baggage is limited to one bag per person travelling and must not exceed the dimensions of 30x28x14cm (12”x11”x6”).

A charge of US$8 or local currency equivalent per traveling day will be charged if a second piece of baggage is permitted to be carried, or if suitcase exceeds weight or size limits.This is not assurance that luggage in excess of limits on size,weight and number of pieces will be permitted to be brought on any of our vehicles.

Samsung Galaxy Note7 smart phone advice: Samsung has announced a voluntary recall and exchange program on certain Galaxy Note7 smart phones. These phones can overheat and catch fire, posing a burn/fire hazard. As the safety of all guests is our top priority, these devices are not allowed on any of our tours.

Smoking

Smoking, including the use of e-cigarettes is not allowed on transportation that is exclusively provided by CGH. Smoking is subject to hotel policy and is strictly prohibited in your apartment accommodation in Olomouc.

Not Included in the Holiday Price

Airfares & airport taxes and fees, passports, visas, vaccinations, gratuities for hosts, drivers and other tour personnel, telephone, mini-bar, alcohol, beverages and food not previously specified by CGH, porterage at airports and train stations, insurance of any kind, baggage fees and all other items of personal nature.

Tipping is not mandatory and is entirely up to customer discretion. When satisfied with the services provided we recommend a total of USD9.00 per person per day to cover all staff that provides services to you during your tour. This includes your CGH host, local guides and drivers.

Acceptance of Risk

Please be aware that during your participation in holidays operated by The Company or use of our private transportation services, certain risks and dangers may arise beyond our control, including but not limited to: the hazards of travelling in undeveloped areas, travel by boat, train, automobile, aircraft, or other means of transportation, forces of nature, political unrest and acts of lawlessness or terrorism. The Company and its respective employees, representatives and agents shall not be liable for any loss or damage of whatsoever nature and howsoever arising ( including, but not limited to, the customer’s or any other person’s injury or death, or any loss of or damage to the customer’s or any other person’s property) which the client or any such other person may incur or suffer as a result of or arising from the customers participation in the tour and any other activities undertaken on or during the tour or use of CGH business transportation services, and the customer irrevocably and forever releases and discharges the Company and its respective employees, representatives and agents from any and all such liability. The customer furthermore indemnifies and holds the Company and its respective employees, representatives and

agents harmless from and against any land all loss, damage, actions, proceedings, claims, demands and legal and other costs and expenses (including legal costs on an attorney and own client scale) of whatsoever nature and howsoever arising (including, but not limited to, the client’s or any other person’s injury or death, or any loss of or damage to the client’s or any other person’s property) which the client or any such other person may incur or suffer as a result of or arising from the clients participation in the tour and any other activities undertaken on or during the tour or the use of our private transportation services.

Dietary Requirements and Allergies

The Company will use its best efforts to cater for your special dietary requirements and allergies. If you have any special dietary requirements please inform The Company at the time of making your reservation. However, The Company cannot guarantee that certain products will not be in food served. The Company will not accept any liability in relation to any medical conditions, special dietary requirements and/or allergies of travellers, even if such conditions are listed in the Emergency Contact Details provided by the traveller. You must make your own decisions when selecting meals.The Company’s comments are only to assist you in making an informed decision.

Jurisdiction

The Customer agrees that the terms of this agreement shall be governed by the laws of the Czech Republic and any dispute shall be heard by the court of appropriate jurisdiction in the Czech Republic.
